How to Submit a DMCA Takedown Notice
To request removal of allegedly infringing material hosted on our service, your written notice must include all elements of 17 U.S.C. §512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list).
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (URL(s) on our site).
- Contact information for the complaining party (name, address, telephone, and email).
- A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner.
Incomplete notices may be delayed or rejected. If the material is on a third-party site we link to or embed, please contact that site’s host or provider directly.
What Happens After We Receive a Valid Notice
- We may remove or disable access to the allegedly infringing material.
- We will notify the user or content provider who posted the material.
- We may forward your notice (including your contact details) to that user and, if requested, provide it to third parties such as Lumen Database, as permitted by law.
How to Submit a Counter-Notification
If your content was removed due to a DMCA notice and you believe it was removed by mistake or misidentification, you may send a counter-notification pursuant to 17 U.S.C. §512(g). Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location (URL) where the material appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or San Francisco, CA if outside the U.S.), and that you will accept service of process from the person who provided the original DMCA notice or their agent.
Upon receipt of a valid counter-notification, we may restore the material within 10–14 business days unless the original complainant informs us that they have filed a court action seeking to restrain the user from engaging in infringing activity relating to the material on our site.
Repeat Infringer Policy
In appropriate circumstances, it is our policy to disable or terminate accounts of users who are determined to be repeat infringers. We also reserve the right to remove content that we believe, in our discretion, may infringe the rights of others.
Misrepresentations
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing (or was removed by mistake) may be liable for damages, including costs and attorneys’ fees. Submit notices and counter-notices in good faith only.
